Simply Maid Clean may revise these terms of use for its web site at any time without notice. By using this web site you are agreeing to be bound by the then current version of these Terms and Conditions of Use.

Governing Law
Any claim relating to Simply Maid Clean’s web site shall be governed by the laws of the State of Texas without regard to its conflict of law provisions.
General Terms and Conditions applicable to Use of a Web Site. The client agrees to be bound and submit to the jurisdiction of the relevant courts of Texas.

General Conditions
Payment is required on commencement of cleaning, subject to other arrangements as made with SMC management.
SCM reserves the right to suspend its cleaning service if payment is not received on presentation or at the start of the month, week or day due as the case may be. All outstanding monies or fees will be charged 2% per month interest from due date plus costs on a lawyer to client basis.
Methods of payment accepted are cash, check, Mastercard, Visa, American Express. Payment for service is due on or before the day of service. A credit card is maintained on file and billing options are discussed as part of client agreement. A 5% per month late fee will be assessed for late payment. A minimum charge of $35.00 dollars will be charged for returned checks.
Prices as per estimate and or quote are for labour only in terms of cleaning and ironing as requested and agreed to by SMC, unless otherwise agreed to by SMC. SMC reserves the right to amend an estimate and /or quote if on arrival conditions and or circumstances are substandard or vary from information provided to SMC to obtain either said quote or estimate. Additional rooms will be charged for.
Time estimates given by SMC for work as requested are only an estimate, as size of the area and the actual level of dirtiness as well as conditions encountered have a direct effect on the time needed. A maid works up to an 7 hr. work shift as a norm and will undertake duties per standard, spring or deep cleans as per requested level of service that may or may not include extras such as ironing and or window or blinds- (Time permitting), unless such was part of the specific level of service requested and agreed to by SMC management. As in pre move etc.
Working with or around contractors and /or other service providers can require up to 50% more time to complete the same work and SMC reserves the right to amend any cost estimates and /or quotes and charge accordingly.
Start and collection times given by SMC are only an estimate as traffic conditions and taxi transport of maids are beyond our control, the amount of maids working on any given day can also take less or more time, high season takes a lot more time, as do month ends.
The client agrees to instruct a maid and or maids on what tasks to do as per their requirements or provide a list of such giving priorities of tasks to be undertaken. Unless otherwise requested and agreed to by SMC, the client shall provide all cleaning equipment in safe and good working order and all detergents, ladder and cleaning equipment that will be required to perform the work. No responsibility is undertaken for using same. SMC charges for detergents and reserves the right to charge for the use of company equipment.
Collection and returning of keys by SMC will attract a surcharge dependent on distance and or time in terms of such extra service. Should there be any loss of such key or key, the liability will be limited to the actual cost of the key only $15.
The client has the responsibility to deactivate any alarms and no responsibility for the triggering of an alarm system or costs related to a response will be accepted by SMC.
SMC reserves the right to suspend or cancel a cleaning service if there are problems with the access, water or electricity supplies, or problems working around other contractors and /or service providers, as well as interference from any party. The client will still be held liable for the full cost of the agreed service.

Cancellation policy
We require a minimum of 24 hours cancellation notice (holidays and weekends included). If you need to cancel or would like to reschedule your appointment please phone or email the office directly. Because we reserve a time specifically for you, please make any schedule changes before 12 p.m. the day before service to avoid incurring a 50% cancellation fee. We appreciate your understanding.

Damage and Loss Policy
Customers must provide images of damage of both before and after the cleaning along with proof that damages were caused at the time of the cleaning. All claims must be made within 12 hours of the cleaning. Once the office receives the notification we will contact you as soon as possible.
The client is responsible for reporting any incident, breakage, damage and loss within 12 hours of completion of the service. Failure to do so will nullify any claim.
The client is responsible for securing – cash, jewelry and any other items of value. Based on SMC compensation structure we have a zero tolerance policy in terms of theft and dishonesty. No responsibility or liability is however accepted for any of the above. A client may inspect the bag of a maid, on arrival and on leaving or keep same in a safe place.
If a client suspects theft or actual theft has taken place, it is the client’s responsibility to report the incident to both management. The client will lay a charge of theft, if actual theft has taken place and follow through to the point of actual prosecution. SMC is indemnified against any claim.
The client or a representative has the responsibility to be present both at the start and end of each service and to inspect any cleaning performed. This will enable SMC to rectify any substandard work while still on the premises. Where a client is not there and SMC was aware of that and SMC is only advised later, we will rectify on the next clean or if possible make other arrangements to do so. This falls away if we were not advised the client would be absent.
Complaints need to be made within 12 hours of the completion of the service.
The client is responsible for securing or removing all fragile or easily breakable, or valuable items from areas that need to be cleaned. Items excluded from any liability by SMC are cash, jewelry, art works, antiques and items of sentimental value.
Lost keys, if lost by a SMC representative will be limited in terms of liability by SMC to the actual cost of the lost key subject to a maximum amount of $15 in total.
SMC reserves the right not to be liable if service is postponed due to broken equipment, or any circumstances beyond our direct control, or if there are issues in terms of safety.
SMC reserves the right not to be responsible for accidental damage of any nature up to the value of $70.

Insurance
SMC has insurance to cover any accidental damages caused by a SMC member of staff at a point of service, subject to the damages been reported within 12 hours of completion of the service in writing either per email or fax to SMC. This is restricted to actual damage and consequential damage is not covered nor will SMC be held liable for such.
Insurance will not cover anything that may break down or stop working at any time and this would include but is not restricted to vacuum, computer, fridge, freezer, microwave, dishwasher, stove, oven, washing machine and tumble dryer or the instability of any item which the client is already aware of, such as headboards, bathroom fixtures or other property fittings. And or chipped or cracked items or services. The client is obliged to notify SMC management of fittings that are poorly secured, not secured or appliances that are not in proper working order. No liability will be accepted by SMC for any of the above or for damage caused directly or indirectly to anything else or anyone else. Any appliance moved for any reason is done at the risk of the client.
SMC reserves the right not to share any confidential company information or documents.

Right to Refuse Service
Maids have the choice to leave upon arrival if the home is in extreme condition or feel unsafe/threatened. If you book a cleaning online that is not reasonable, such as a cleaning up after a large party, the cleaners may refuse service on the spot and you will be charged the maximum cancellation fee.

Complaints and Re-Cleans
Any refunds will not be given if not contacted within 12 hours of the cleaning nor any re-cleans will be done if not notified within 12 hours. Any re-cleans can only be done with the same maid and only within the first 48 hours of the initial cleaning. If you do not want the same maid to come you will be charged a fee for another maid to come out.

No client will be entitled to a full or partial refund; this is subject to the discretion of management.
Should a client not be satisfied with the level of service from a maid and such is conveyed to management within the prescribed 12hr period of completion of the service, SMC reserves the right to do a re-clean of the specific area at an agreed time. The client will need to be present during the re-clean.

Where a client is not there and SMC was aware of that and SMC is only advised later, we will rectify on the next clean or if possible make other arrangements to do so. The above voids if we were not advised the client would be absent.
A re-clean will only be carried out once.

Simply Maid Clean Employees
No staff member or ex staff of SMC may be offered or given temporary or permanent employment by the client directly or indirectly (family, work) without prior negotiation with SMC. The period of protection is agreed to as 2 (two) years. This applies to the date of termination of services of SMC by the client irrespective of any cause or reason. Should a staff or ex staff member be employed within the said 2 year period the client agrees to be liable for a referral fee calculated @ $142 per day that SMC provided service in a given week. This will be calculated on the basis of the higher of – the highest number of days in any given week within a retrospective 3 month period and – the amount of days per week the maid is employed for by the client/ex client.
Washing and Ironing are done on behalf of a client. The client is responsible for instructing the maid on separating colors and fabrics both for washing and ironing. A steam iron in good working condition is required and cool (synthetic) and high temp as cotton need to be separated and the maid instructed accordingly. This service is at the clients’ risk.
Any electrical or other equipment to be moved is moved at the exclusive risk of the client.
